Requirements for the course itself
Under the State Bar of Texas rules currently effective April 24, 2026, an accredited CLE activity needs substantive educational content appropriate for lawyers. Texas recognizes approved live programs, live online programs, prerecorded/on-demand programs, and other approved formats.
For your mediation program, the important point is that mediation/ADR can qualify. The course should be structured as legal professional education—for example, Texas mediation law and procedure, ethics, confidentiality, enforceability of mediated settlement agreements, negotiation within legal disputes, mediator responsibilities, and relevant statutes/case law.
Texas specifically excludes programs primarily designed to market products/services, attract clients, teach general communication skills, career building, rainmaking/marketing, or other non-legal skills. A text-only online course also does not qualify as accredited CLE.
That distinction matters for ADR Mediator: a course called "Mediation Training" isn't automatically eligible simply because it concerns mediation. The portions submitted for Texas MCLE should demonstrate substantive legal/professional education.
